Michigan is referred to as a "no fault" divorce state. The meaning of this term is that it is not necessary for either party to prove the fault of the other in order to be granted a divorce. The court?s only requirement is that it finds that there has been a breakdown of the marriage relationship to the extent that the objects of matrimony are no longer possible and there remains no reasonable likelihood that the marriage can be saved or preserved. If the court finds that this is the case it is required to grant the party a Judgment of Divorce if requested after such time as division of property and custody has been determined.
